9 "Whereas, under Article 46 of the Constitution of India, the State shall promotes with special care, among other matters, the economic interests of the weaker section of the people and in particular of the Scheduled Tribe. And, whereas, the Govt. of Assam had been allowing certain concession in regard to the settlement of contracts, permits, fisheries, ferries, forest mahals, tolls supply of all materials and articles to Govt. etc.., to safeguard the economic interest of the scheduled Tribes. And, whereas, the Govt. of Mizoram has in their No.HG.61/73/12 dt. 5.12.1973 continued such concession with certain modifications. And, whereas, the said order is not very clear in certain respects; Now, therefore, this House resolves that: (i) In respect of auctions or tenders which are settled at the lowest bid the auction or tender may be settled on a scheduled Tribe 12 percent above the lowest bid; and (ii) In the case of auctions or tenders settled on the highest bid the auction or tender may be settled on scheduled tribes at 12 percent below the highest bid.
